Securities Arbitration
One of the main
practice areas of the Partners of LAX & NEVILLE,
LLP, is securities arbitration. Our
years of specialization in this area and experience as in-house
counsel truly separate us from our competition. The Partners
worked at such firms as Prudential Securities, Josephthal,
and CIBC Oppenheimer in the 1990’s before venturing
out to different areas of legal work mainly defending brokerage
firms in all aspects of litigation. Building on their knowledge
of the brokerage industry, the Partners went on to work at
boutique or mid sized law firms dedicated to the representation
of brokerage firms. To this day, the firm’s Partners
continue to bring their in-house arbitration experience to
each case on which the firm is retained. To this end, we
continue to serve a base of smaller and regional broker dealers,
while remaining fiercely independent from, and often times
adverse to, the larger wire-houses. Because we are a small
firm by New York City standards, we believe we can bring
first tier representation to cases that the large litigation
power houses simply cannot handle in a cost effective manner.
On behalf of investors, the Partners
of LAX & NEVILLE,
LLP, have recovered almost $20,000,000 in claims against
brokerage firms. Our success was, in part, based our knowledge
of the inner workings of a retail brokerage firm, including
its supervisory systems, which have become second nature
to us. The Partners have tried over 150 arbitrations to final
awards in virtually every major city in the United States,
many times using nationally recognized expert witnesses.
It is this record and reputation that prompts adversaries
to settle matters.
Many broker dealer arbitrations
settle through a process called mediation. In mediation,
a mutually selected neutral
mediator assists the parties to reach settlement. The Partners
of LAX & NEVILLE,
LLP, frequently use mediation to achieve
settlement of a matter, and have been featured as speakers
at Bar Association and/or other seminars on the topic.
