Brian Maddox is an associate with LAX & NEVILLE, LLP. Mr. Maddox's practice focuses in the areas of commercial and civil litigation, in both federal and state courts. Mr. Maddox has represented clients in civil and commercial matters concerning securities litigation, breach of contract actions, business torts cases, bankruptcy and adversary proceedings, oppressed minority shareholder disputes, and product liability litigation. Brian's product liability experience focused on the defense of tort and personal injury claims, deceptive trade practices, and consumer claims. His experience includes all aspects of trial litigation, including discovery, motion practice, liability evaluation, alternative dispute resolution, trial and appeals.
Mr. Maddox is currently representing numerous Madoff Victims in actions against the Madoff Trustee who seeks to bring clawback actions alleging fraudulent conveyance and/or preference claims under 11 U.S.C. 542, 11 U.S.C. 544(b), 11 U.S.C. 547(b), 11 U.S.C. 548(a), 11 U.S.C. 550, 11 U.S.C. 551, and under New York Debtor and Creditor Law 273 to 279.
Mr. Maddox recently participated as a member of a litigation team serving as special litigation counsel to Enron Corp. in a preference and fraudulent conveyance action against numerous large financial institutions involving commercial paper transactions and other complex financial transactions. On behalf of the Enron Estate, Mr. Maddox's firm was successful in a clawback action worth approximately $600 million. (Enron Corp. v. JP Morgan Securities (In re Enron Corp.), 325 B.R. 671, Bankr. S.D.N.Y. 2005.)
Mr. Maddox participated in the representation of Cooper Tire and Rubber Company in numerous product liability cases involving incidents of tire malfunction while a vehicle is in motion. For several years, Brian was a member of Cooper Tire & Rubber Company's National Discovery Team, with a focus towards drafting, briefing and arguing motions across multiple states for various discovery-related matters.
Brian was also part of a team of attorneys, which visited and provided pro-bono habeas representation to three detainees in Guantanamo Bay, Cuba.
Prior to his engagement with LAX & NEVILLE, LLP, Mr. Maddox was an associate at the law firms of Venable LLP and Fulbright & Jaworski, LLP. Prior to attending law school, Brian was a second lieutenant in the United States Army.
Mr. Maddox holds a B.A. in Environmental Engineering from the United States Military Academy and a J.D. from Vermont Law School.
